Terms and Conditions of The Public Bored

Welcome to The Public Bored (“Company,” “we,” or “us”). By accessing or using our services, including our website, applications, digital billboards, and associated tools (collectively, the “Platform” or “Services”), you agree to be bound by these Terms and Conditions (“Terms”).

If you do not agree to these Terms, please stop using the Platform immediately.

We may update these Terms periodically. Continued use of the Platform after changes are made constitutes acceptance of the revised Terms.

 

1. Eligibility and Accounts

 

1.1 Eligibility

  • You must be at least 13 years old to use The Public Bored and assume the obligations set forth in these Terms.
  • If you are under 18, you may only use the Platform with the permission and supervision of a parent or guardian.

1.2 Account Registration

  • To use certain features, you may need to create an account with accurate and complete information.
  • You agree not to share your login credentials or allow others to access your account.
  • If you use the Platform on behalf of a company, you warrant that you have authority to bind them to these Terms.

1.3 Security

  • You are responsible for maintaining account security and for all activity under your account.
  • Notify us immediately if you suspect unauthorized access.
  • We are not liable for losses resulting from unauthorized access due to your failure to secure your account.

 

2. The Platform and Services

 

2.1 Description

The Public Bored is a digital advertising platform that allows users to submit multimedia content (images, text, videos) for display on public digital billboards.

2.2 Content Submission and Display

  • You retain ownership of your submitted content (“User Content”) but grant us a non-exclusive, royalty-free, worldwide license to use, display, distribute, and modify your content across our platform.
  • We do not guarantee specific ad placement, display frequency, or duration.
  • If we determine your content violates these Terms, we may modify, remove, or restrict it.

2.3 Budget and Advertising Preferences

  • The Public Bored allows you to set budgetary limits and choose ad display preferences.
  • If you select automated optimization, you authorize us to allocate your budget for better performance.
  • You acknowledge that unexpected billboard outages or technical issues may affect ad delivery.

2.4 Alternative Display Channels

  • Your content may also be displayed on other channels (e.g., social media, website listings) to enhance visibility.
  • You may opt out of alternative display methods by contacting us.

 

3. User Conduct and Prohibited Activities

By using The Public Bored, you agree to be solely responsible for any content, messages, data, text, software, music, sound, photographs, graphics, video, code, or any other materials (“Content”) that you upload, post, publish, display, or otherwise make available through our platform (collectively, “upload”).

We are committed to maintaining a safe, legal, and respectful environment for all users. The Public Bored strictly prohibits the following activities and behaviors:

3.1 Prohibited Content

You agree not to upload, post, or distribute any content that:

    • Violates any intellectual property rights, including copyrights, trademarks, patents, trade secrets, or any other proprietary rights of third parties.
    • You do not have the legal right to share, including confidential, proprietary, or personal information obtained unlawfully.
    • Contains viruses, malicious code, or any software designed to disrupt, damage, or limit the functionality of our platform, any hardware, or telecommunications equipment.
    • Creates a security or privacy risk for any person, including sharing private information without consent.
    • Is illegal, misleading, fraudulent, obscene, defamatory, harassing, violent, excessively graphic, abusive, tortious, hateful, discriminatory, or otherwise objectionable in the sole judgment of The Public Bored.
  • Content that promotes violence, discrimination, or explicit hate speech against individuals or groups based on race, religion, gender, sexual orientation, or other protected categories is strictly prohibited.
  • Constitutes unauthorized advertising, spam, chain letters, pyramid schemes, or other promotional content, including contests and sweepstakes that are not approved by The Public Bored.
  • Encourages or promotes criminal activity, self-harm, or violence of any kind.

3.2 Prohibited Actions and Behaviors

You further agree that you will not:

  • Interfere with, disrupt, or impair the functionality of the Platform, including hacking, denial-of-service attacks, or any attempt to disable or overload our servers.
  • Violate any applicable laws, regulations, or legal obligations, including but not limited to local, state, national, or international laws.
  • Impersonate any person or entity, falsely represent your affiliation with any individual or business, or misrepresent the source of your content.
  • Solicit personal information from anyone under the age of 18.
  • Harvest or collect data (including email addresses or user contact information) from the Platform for unsolicited communications or unauthorized marketing purposes.
  • Use the Platform to sell, buy, or advertise goods or services that are not specifically authorized by The Public Bored.
  • Engage in unauthorized scraping, data mining, or similar data gathering and extraction techniques.
  • Circumvent, remove, alter, deactivate, degrade, or bypass any content protections or geographic restrictionson content available through the Platform.
  • Attempt to access restricted areas of the Platform or obtain unauthorized content through hacking, password mining, or other illicit means.
  • Use VPNs, proxies, or other methods to bypass geographic restrictions, account suspensions, or security measures imposed by The Public Bored.

3.3 Enforcement and Consequences

The Public Bored reserves the right to:

  • Investigate and take legal action against anyone suspected of violating these terms.
  • Remove or modify any content that, in our sole discretion, violates these Terms.
  • Suspend or permanently terminate your account without prior notice if you are found to be in violation of these Terms.
  • Report unlawful activity to law enforcement authorities when appropriate.

Failure to comply with these guidelines may result in immediate account suspension or termination at the sole discretion of The Public Bored.

By continuing to use The Public Bored, you acknowledge and agree to abide by these User Conduct and Prohibited Activities terms.

 

3.4 Competitors

No employee, independent contractor, agent, or affiliate of any competing digital advertising or social media company is permitted to view, access, or use any portion of The Public Bored platform without express written permission from The Public Bored.

By accessing or using the Platform, you represent and warrant that you are not:

  • A competitor of The Public Bored or any of its affiliates.
  • Acting on behalf of, consulting for, or providing services to a competitor in any capacity.

Any unauthorized access or use by competitors is a violation of these Terms and may result in legal action, account termination, and/or further enforcement measures.

 

4. Fees, Payments, and Refunds

 

4.1 Fees and Billing

  • Access to certain features of The Public Bored may require payment. You may be required to select a payment plan and provide accurate billing information, including a valid credit card or other payment method.
  • By providing payment information, you represent and warrant that:
    • The information is true, complete, and up to date.
    • You are authorized to use the provided payment method.
    • You will promptly update any billing information that changes (e.g., credit card expiration, billing address).
  • If your selected payment plan includes a recurring subscription, you authorize The Public Bored (or its third-party payment provider) to automatically bill your payment method in advance on a periodic basis until you cancel.
  • If you dispute any charges, you must notify The Public Bored within 60 days of the charge.

4.2 Automatic Billing and Renewals

  • If you subscribe to a recurring advertising plan, your subscription will automatically renew at the end of each billing cycle unless you cancel.
  • You must cancel at least 24 hours before renewal to avoid being charged for the next billing period.
  • After cancellation, you will retain access to subscription features until the end of your current billing cycle, after which your access will be discontinued.

4.3 Dormant Account Fees

  • Accounts with no activity for 12 months may be classified as dormant and subject to a monthly maintenance feeequal to 5% of the remaining balance or $50, whichever is greater.
  • To reactivate a dormant account, you must engage in a qualifying activity, such as placing an ad.
  • Under certain circumstances (e.g., prolonged illness, military service, or other extenuating situations), users may request a waiver for dormant account fees. Requests must be submitted in writing and will be reviewed on a case-by-case basis.

4.4 Refunds

  • All fees are non-refundable, except in cases where The Public Bored fails to display an ad due to a platform error.
  • Subscription-based payments are non-refundable. If you cancel, you will not receive a refund or credit for partial-period access.
  • If your payment is processed via a third-party provider (such as the Apple App Store), refund requests must be handled through the third-party provider’s refund policies.

4.5 Changes to Fees and Subscriptions

  • The Public Bored reserves the right to change pricing, payment terms, or discontinue subscription features at any time.
  • If a price change affects your subscription, we will provide reasonable notice through email, a pop-up notice, or other means at least 30 days in advance.
  • Your continued use of the Platform after the price change becomes effective constitutes your agreement to the new pricing.

4.6 Commercial Use Restrictions

  • Unless expressly authorized in writing, you may not:
    • Resell, license, distribute, or exploit any portion of The Public Bored platform for commercial purposes.
    • Copy, modify, create derivative works, or publicly display platform content outside of permitted advertising functions.
  • The Platform is for your personal or authorized business use only.

4.7 External Destinations

  • You are solely responsible for any external destinations linked to your ad content, including but not limited to:
    • Websites, landing pages, phone numbers, or physical locations.
    • Any products, services, or information offered at those destinations.
  • The Public Bored does not endorse, monitor, or take responsibility for any content, transactions, or claims related to third-party destinations.

 

5. Intellectual Property

 

5.1 Our Rights

  • The Public Bored name, logo, website, and Platform design are our property and may not be copied, modified, or used without permission.

5.2 User Content and Publicity Rights

  • By submitting content, you grant us the right to use, distribute, and promote your content as part of our marketing efforts.
  • We may use your business name and logo in promotional materials unless you opt out.

 

6. Indemnification, Disclaimers, and Limitation of Liability

 

6.1 No Guarantee of Results

The Public Bored provides a digital advertising platform but does not guarantee any specific outcomes, engagement levels, visibility, or sales from advertisements displayed on our billboards or digital platforms.

All services and features are provided “as is” and “as available”, without any express or implied warranties, including but not limited to:

  • Merchantability, fitness for a particular purpose, or non-infringement;
  • That the Platform will always be secure, available, or error-free;
  • That technical issues, outages, or content delivery problems will be resolved immediately;
  • That advertisements will be displayed exactly as scheduled or as expected by the user.

By using the Platform, you acknowledge and agree that you are solely responsible for your own business outcomes and for ensuring that any content or advertisements meet your expectations before submission.

6.2 Indemnification

You agree to indemnify, defend, and hold harmless The Public Bored, its parent company, affiliates, subsidiaries, officers, directors, employees, agents, licensors, and third-party partners (collectively, the “Indemnified Parties”) from and against any claims, losses, damages, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising out of or related to:

  • (a) Your use or inability to use the Platform;
  • (b) Your submitted content or advertisements, including any claims of false advertising, defamation, copyright infringement, or privacy violations;
  • (c) Your violation of these Terms, applicable laws, or regulations;
  • (d) Your infringement of any intellectual property, privacy, or other rights of a third party;
  • (e) Any unauthorized or unlawful use of the Platform by someone using your account.

We reserve the right to assume the exclusive defense and control of any claim that is subject to indemnification by you, at our own expense. In such cases, you agree to fully cooperate with us in asserting any available defenses.

6.3 Limitation of Liability

(a) No Liability for Indirect or Consequential Damages

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE PUBLIC BORED AND ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, SHAREHOLDERS, AGENTS, THIRD-PARTY CONTRACTORS, SUPPLIERS, AND LICENSORS (COLLECTIVELY, “THE PUBLIC BORED PARTIES”) SHALL NOT BE LIABLE FOR ANY SPECIAL, EXEMPLARY, PUNITIVE, CONSEQUENTIAL, INCIDENTAL, OR INDIRECT DAMAGES, INCLUDING BUT NOT LIMITED TO:

  • LOST PROFITS, REVENUE, OR BUSINESS OPPORTUNITIES;
  • LOSS OF OR DAMAGE TO DATA, FILES, OR DIGITAL CONTENT;
  • COSTS OF RECOVERING OR REPRODUCING FILES OR DATA;
  • SERVICE INTERRUPTIONS, PLATFORM DOWNTIME, OR TECHNICAL MALFUNCTIONS;
  • UNAUTHORIZED ACCESS TO OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT;
  • ANY LOSS OR DAMAGE RESULTING FROM INTERACTIONS WITH THIRD PARTIES THROUGH THE PLATFORM.

This applies regardless of the legal basis for the claim, whether in contract, negligence, strict liability, or otherwise, even if The Public Bored has been advised of the possibility of such damages, and even if such damages were reasonably foreseeable.

(b) Maximum Liability Cap

IF, DESPITE THE ABOVE, THE PUBLIC BORED PARTIES ARE FOUND LIABLE TO YOU OR ANY THIRD PARTY, THE TOTAL AGGREGATE LIABILITY SHALL NOT EXCEED:

  • THE GREATER OF $100 OR THE LOWEST AMOUNT PERMITTED BY LAW.

This limitation reflects a mutually agreed-upon allocation of risk between you and The Public Bored, given the nature of the services provided.

(c) Jurisdiction-Specific Exceptions

Some jurisdictions do not allow certain limitations on liability or do not permit the exclusion of certain damages. In such jurisdictions, The Public Bored’s liability shall be limited to the maximum extent permitted by law.

 

7. Arbitration and Dispute Resolution

 

7.1 Informal Dispute Resolution

If a dispute arises regarding The Public Bored, please contact us first. We will attempt to resolve the matter quickly and informally before proceeding to formal legal action.

7.2 Binding Arbitration Agreement

If an informal resolution is not possible, you agree that any dispute, claim, or controversy arising out of or relating to your use of The Public Bored or these Terms—including the interpretation, scope, or enforcement of this arbitration provision—shall be resolved exclusively through final, binding, and non-appealable arbitration.

  • Arbitration replaces the right to file a lawsuit in court.
  • Arbitration is conducted by an independent, neutral arbitrator instead of a judge or jury.
  • The arbitration award is final and enforceable, with limited rights to appeal.
  • The arbitrator may award the same damages or relief that a court could award.

7.3 Arbitration Rules and Location

  • The arbitration will be administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, available at www.adr.org.
  • Unless otherwise agreed, arbitration will take place in Delaware, in accordance with Delaware law.
  • If your claim is for $10,000 or less, arbitration may be conducted:
    • Solely based on submitted documents.
    • Through a telephonic hearing.
    • In person, as determined by AAA rules.
  • If your claim exceeds $10,000, your right to a hearing will be determined by AAA rules.

7.4 Fees and Costs

Each party will pay its own arbitration fees unless:

  • Your claim is for $75,000 or less and not frivolous—in which case The Public Bored will cover reasonable arbitration costs as determined by AAA.

7.5 Class Action and Jury Trial Waiver

By agreeing to these Terms, you waive your right to participate in a class action lawsuit or class-wide arbitration.

  • All claims must be brought in an individual capacity.
  • The arbitrator cannot consolidate claims from multiple users.
  • You and The Public Bored waive the right to a trial by jury.

7.6 Injunctive and Equitable Relief

Nothing in this section prevents either party from seeking injunctive relief or other equitable remedies in court for:

  • Intellectual property disputes (e.g., trademark or copyright violations).
  • Unauthorized access, data breaches, or security violations.

7.7 Governing Law and Jurisdiction

  • These Terms shall be governed by the laws of the State of Delaware, without regard to conflict of law principles.
  • If arbitration is found unenforceable for any reason, all disputes shall be resolved exclusively in the state or federal courts of Delaware.
  • You agree to submit to the jurisdiction of these courts and waive any objections based on forum non conveniens.

7.8 Non-Waivable Statutory Rights

Nothing in this section affects any non-waivable statutory rights that may apply to you.

8. Term and Termination

These Terms become effective upon your acceptance and will remain in effect indefinitely unless terminated by either party.

8.1 Termination by You or Us

  • You may terminate your account at any time, for any reason, by providing us with written notice.
  • We reserve the right to suspend or terminate your account at any time, for any reason or no reason, with or without notice.

8.2 Grounds for Suspension or Termination

We may suspend or terminate your access to the Platform immediately if we determine, in our sole discretion, that you:

  • Violate these Terms or any applicable laws;
  • Engage in fraudulent, deceptive, or misleading activities;
  • Fail to make payments when due or attempt to circumvent payment obligations;
  • Use the Platform in a manner that may cause harm to The Public Bored, its users, or third parties.

8.3 Effect of Termination

  • Upon termination, your right to access and use the Platform immediately ceases.
  • You forfeit any remaining balance in your account, and no refunds will be issued unless required by law.
  • Any obligations or liabilities incurred prior to termination (such as unpaid fees or legal claims) will survive termination.

By continuing to use the Platform, you acknowledge and agree to these termination terms.

 

9. Assignment

 

9.1 Assignment

You may not transfer, assign, or delegate any of your rights or obligations under these Terms without prior written consent from The Public Bored. Any attempted assignment without consent will be null and void.

We reserve the right to assign, transfer, or delegate our rights and obligations under these Terms without restriction, including but not limited to:

  • Corporate restructuring (merger, acquisition, or sale of assets);
  • Legal compliance (transferring agreements to a successor entity);
  • Operational necessities (outsourcing specific functions to third parties).

In the event of an assignment by The Public Bored, we will provide reasonable notice to affected users.

 

10. Severability and Waiver

 

10.1 Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, the remaining provisions shall remain in full force and effect.

The unenforceable provision shall be:

  • Modified to the minimum extent necessary to make it enforceable, while maintaining its intent; or
  • Removed, if modification is not possible, with the rest of the Terms remaining valid.

10.2 No Waiver

Failure to enforce any provision does not constitute a waiver of our right to enforce it in the future.

 

11. Governing Law and Jurisdiction

 

11.1 Governing Law

These Terms and your use of The Public Bored Platform are governed by and interpreted under the laws of the State of Delaware, USA, without regard to conflict of law principles that would apply the laws of another jurisdiction.

11.2 Jurisdiction

Any legal disputes or claims arising out of or related to these Terms shall be exclusively resolved in the state or federal courts of Delaware.

You irrevocably consent to the jurisdiction and venue of these courts and waive any objections to such jurisdiction based on forum non conveniens or any other reason.

 

12. Disclaimers and Limitations

 

12.1 General Disclaimers

We do not owe any fiduciary duty to you. You alone are responsible for your use of The Public Bored platform and the consequences thereof.

THE PUBLIC BORED PROVIDES THE PLATFORM “AS IS” AND “AS AVAILABLE”, WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

  • TITLE, NON-INFRINGEMENT, MERCHANTABILITY, AND FITNESS FOR A PARTICULAR PURPOSE;
  • ANY WARRANTIES ARISING FROM A COURSE OF PERFORMANCE, USAGE, OR TRADE;
  • THAT THE PLATFORM WILL BE SECURE OR AVAILABLE AT ALL TIMES;
  • THAT ANY DEFECTS OR ERRORS CAN OR WILL BE CORRECTED;
  • THAT THE PLATFORM OR ANY CONTENT ON IT IS FREE FROM VIRUSES OR OTHER HARMFUL COMPONENTS;
  • THAT YOUR USE OF THE PLATFORM WILL MEET YOUR REQUIREMENTS OR EXPECTATIONS.

YOUR USE OF THE PLATFORM IS SOLELY AT YOUR OWN RISK.

 

13. Changes to These Terms

 

13.1 Updates to These Terms

We may modify these Terms at any time, with changes becoming effective immediately upon posting.

 

14. Notices and Communication

 

14.1 Notice

Any notices, communications, or legal disclosures required or permitted under these Terms may be provided electronically via:

  • Email to the address associated with your account;
  • Platform notifications or pop-up messages;
  • Updates posted on our website.

Notices sent via email shall be deemed delivered and effective immediately upon sending, unless we receive an automatic notification that the email was undeliverable.

It is your responsibility to keep your contact information accurate and up to date to ensure receipt of notices.

If required by law, we may also provide notices in writing via postal mail to your last known address.

 

15. Entire Agreement and Amendments

 

15.1 Entire Agreement

These Terms, along with any policies, guidelines, or agreements expressly incorporated herein, constitute the entire agreement between you and The Public Bored regarding the use of the Platform.

These Terms supersede any prior agreements, understandings, or representations, whether oral or written.

15.2 Amendments

We reserve the right to modify, amend, or update these Terms at any time at our sole discretion.

Changes to the Terms will be effective immediately upon posting on our website or through direct communication.

Your continued use of the Platform after updates constitutes acceptance of the modified Terms. If you do not agree with any modifications, you must discontinue use of the Platform immediately.

 

16. Force Majeure

 

16.1 No Liability for Unforeseen Events

The Public Bored shall not be liable for any failure, delay, or unavailability of the Platform due to circumstances beyond our reasonable control, including but not limited to:

  • Acts of God (earthquakes, floods, hurricanes, wildfires, etc.);
  • Power failures, telecommunications disruptions, or internet outages;
  • Data loss or corruption due to software or hardware malfunctions;
  • Riots, civil unrest, acts of vandalism, or terrorism;
  • Strikes, labor disputes, or supply chain disruptions;
  • Acts or omissions of civil or military authorities, government restrictions, or legal orders.

If such events occur, The Public Bored will make reasonable efforts to restore operations but shall not be held responsible for any resulting service interruptions.

 

17. Interpretation and Documentation

 

17.1 Headings and Interpretation

The section headings used in these Terms are provided for reference purposes only and shall not affect the meaning, interpretation, or enforceability of any provisions.

Any ambiguity in these Terms shall not be construed against The Public Bored but shall be interpreted fairly and in accordance with applicable law.

17.2 Electronic Documents and Agreement

These Terms, along with any other electronic documents referenced herein, shall be deemed:

  • A “writing” or “in writing” for all legal, regulatory, and contractual purposes.
  • Legally binding and enforceable to the fullest extent permitted by law.

A printed version of these Terms and any electronically delivered notices shall be admissible in judicial or administrative proceedings to the same extent as other legally maintained business records.

Your use of the Platform constitutes your agreement to be bound by these Terms, whether electronically signed or not.

 

18. SMS Messaging and Communications

 

18.1 SMS Notifications and Authentication

  • The Public Bored may send SMS (Short Message Service) messages, including but not limited to:
    • Two-factor authentication (2FA) for security purposes.
    • Service notifications regarding your account and usage.
    • Promotional or informational messages, if you have opted in.
  • Message and data rates may apply depending on your wireless carrier plan.

18.2 Opting In and Managing SMS Preferences

  • By providing your phone number and opting in, you agree to receive text messages from The Public Bored.
  • If you are not a registered user, other users may send you an SMS invite through the Platform.
  • To opt-out of SMS communications at any time, text “STOP” to the number that texted you. You will receive a confirmation message, and no further messages will be sent.
  • To request help, text “HELP” to the number that texted you, and we will respond with instructions on how to manage your SMS preferences.

18.3 Carrier and Service Limitations

  • Your carrier’s messaging rates apply for all SMS messages sent and received.
  • The Public Bored is not responsible for any fees charged by your mobile provider in connection with SMS communications.
  • Supported carriers may include, but are not limited to: AT&T, Verizon Wireless, Sprint, T-Mobile, Alltel, CellularOne, Virgin Mobile, U.S. Cellular, and Metro PCS.
  • Wireless carriers are not liable for lost, delayed, or undelivered messages.

18.4 SMS Service Availability and Modifications

  • To use SMS services, you must:
    • Have an active mobile subscription with a participating carrier.
    • Use a compatible mobile device capable of receiving text messages.
  • If the service requires upgrades or modifications to your equipment or software, you must make those changes at your own expense.
  • The Public Bored reserves the right to modify, suspend, limit, or discontinue SMS services at any time, without liability.
  • While we strive to keep the service available, there may be occasional interruptions due to maintenance, upgrades, or factors beyond our control.

18.5 Providing Accurate Information

  • When registering an account via SMS, you must provide:
    • Your full name, phone number, and valid account details.
  • By signing up, you agree to:
    • Provide accurate, current, and complete information.
    • Promptly update any information that changes.
  • If we determine that your information is false, outdated, or incomplete, we reserve the right to suspend or terminate your account.

 

19. Concerning Copyrights and Intellectual Property

 

19.1 Protection of Intellectual Property

The Public Bored’s platform, content, trademarks, and other proprietary materials are protected by copyright, trademark, and other intellectual property laws. You may not use, copy, modify, distribute, or exploit any part of our Platform, software, or content in any way that violates third-party rights or applicable laws.

We strictly prohibit the uploading, sharing, or publishing of content that infringes on copyrights, trademarks, patents, or other proprietary rights of any person or entity.

19.2 Reporting Copyright and Intellectual Property Violations

If you believe that any content on The Public Bored infringes your copyright, trademark, or other intellectual property rights, you (or an authorized representative) may submit a complaint. Only the rights owner or a legally authorized agent may submit a claim.

20. Apple App Store Terms

The following terms and conditions apply only if you are accessing or using The Public Bored app via the Apple App Store. If any provision of these Terms is less restrictive or conflicts with the Apple App Store terms, the more restrictive or conflicting Apple terms shall apply solely to your use of the app on Apple devices.

20.1 Relationship with Apple

  • If The Public Bored app fails to conform to any applicable warranty, you may notify Apple, and Apple may refund the purchase price (if any) for the app.
  • To the maximum extent permitted by law, Apple has no other warranty obligations regarding The Public Bored app.

20.3 Apple’s Limited Liability
